1. INTRODUCTION

Welcome to Nukumi Club.

Nukumi Club is an independent adults-only boutique club located in Santa Catalina, Panama.

Nukumi Club exclusively provides private boutique-style accommodation and operates similarly to an Airbnb-style hospitality concept.

The property does not operate as a traditional hotel and does not provide:

  • 24/7 reception
  • restaurant service
  • commercial bar service
  • permanent daily hotel-style service

By making a reservation through:

  • our website
  • Guesty
  • Airbnb
  • Booking.com
  • VRBO
  • Expedia
  • or directly with the property

guests acknowledge that they have read, understood, and accepted:

  • these Terms & Conditions
  • our Privacy Policy
  • the club rules
  • all applicable reservation policies

2. CLUB CONCEPT & ADULTS-ONLY POLICY

Nukumi Club is a strictly adults-only property reserved exclusively for guests aged 18 years or older.

No children, babies, or minors are permitted on the property under any circumstances.

This policy exists to preserve:

  • tranquility
  • guest experience
  • safety
  • the overall concept of the club

Identification or passports may be requested at any time to verify guest age.

Any reservation involving minors may be:

  • refused
  • canceled
  • terminated immediately without refund

Guests remain fully responsible for the accuracy of the information provided during the reservation process.

3. RESERVATIONS & BOOKING CONFIRMATION

A reservation is considered confirmed only once the required payment has been successfully validated according to the applicable booking method.

OTA Reservations

For certain OTA platforms such as:

  • Airbnb
  • Expedia
  • VRBO

payments are collected directly by the platform.

Booking.com & Direct Reservations

In certain regions, including Panama and parts of Latin America, Booking.com may not process guest payments directly for some properties.

In these cases:

  • payment collection is handled directly by Nukumi Club
  • through Charge Automation
  • Tilopay
  • bank transfer
  • or secure payment links

This structure depends on:

  • regional limitations
  • available payment systems
  • platform operational policies

Nukumi Club reserves the right to cancel unpaid reservations after reasonable contact attempts via:

  • email
  • WhatsApp
  • phone

Certain information may be requested prior to arrival, including:

  • passport
  • phone number
  • email address
  • billing information
  • information required for Panamanian fiscal obligations

4. RATES, TAXES & CURRENCY

All rates are expressed in U.S. Dollars (USD).

Rates may vary depending on:

  • season
  • events
  • promotions
  • booking platforms
  • length of stay
  • pricing strategies

OTA platforms may occasionally apply:

  • their own promotions
  • automatic discounts
  • marketing campaigns
  • pricing adjustments independent from Nukumi Club

Rates displayed on some platforms or booking engines may not immediately include ITBMS (Panamanian lodging tax).

The applicable ITBMS is currently 10% per night according to Panamanian fiscal regulations.

For reservations made directly through our website, ITBMS may appear separately before the final payment step.

When reservations are arranged directly through:

  • email
  • WhatsApp
  • telephone
  • private direct communication

Nukumi Club may communicate rates including all applicable taxes for easier understanding of the final stay cost.

5. PAYMENT TERMS

Direct payments may be processed through:

  • Charge Automation
  • Tilopay
  • international bank transfer
  • other approved payment methods

Cash payments are generally not accepted for initial reservations.

Cash payments may exceptionally be accepted only:

  • for stay extensions
  • for guests already staying at the property

Certain international banks may temporarily block or refuse international payments to Panama.

In such cases, guests remain fully responsible for:

  • contacting their bank
  • authorizing the transaction
  • ensuring their bank accepts international transactions to Panama

All fees related to:

  • transfers
  • intermediary banks
  • correspondent banks
  • currency conversions
  • international banking fees
  • processing fees

remain entirely the responsibility of the guest.

Nukumi Club cannot be held responsible for:

  • banking refusals
  • transfer delays
  • international limitations
  • payment interruptions
  • additional fees imposed by third-party financial institutions

Reservations may remain suspended until the full payment amount has been received.

6. LEGAL DISCOUNTS IN PANAMA (ACODECO)

Certain legal discounts established under Panamanian law may apply in specific situations.

Examples include:

  • Law 6 of June 16, 1987 (retirees / pensioners)
  • Law 134 of December 31, 2013 (certain disability-related protections and rights)

These discounts:

  • must be requested before payment
  • apply only to direct reservations
  • require valid official documentation

Nukumi Club reserves the right to request:

  • passport
  • national ID
  • residency documentation
  • official cards
  • certificates
  • additional supporting documents

No discounts may be applied retroactively after payment confirmation.

7. CANCELLATION & REFUND POLICY

Any cancellation made:

  • more than 5 full days before official check-in time (3:00 PM Panama time)

qualifies for a full refund.

Any cancellation made:

  • less than 5 full days before check-in

is non-refundable.

The total stay amount, including applicable taxes, may be retained.

OTA Refunds

For reservations made through:

  • Airbnb
  • Expedia
  • VRBO
  • or other OTAs

refunds are managed directly by the platform according to its own procedures.

Direct Reservations & Booking.com

For:

  • direct reservations
  • Charge Automation payments
  • Tilopay payments
  • certain Booking.com reservations

refunds are processed through the original payment method whenever possible.

No-shows & Early Departures

No-shows and early departures are strictly non-refundable.

8. FORCE MAJEURE

Force majeure situations are reviewed only upon presentation of official supporting documentation.

Potentially accepted situations include:

  • official border closures
  • major natural disasters preventing access
  • severe hospitalization
  • death of a parent, child, sibling
  • official flight cancellation without alternative routing

The following are generally NOT considered force majeure:

  • rain
  • tropical weather
  • bus delays
  • travel fatigue
  • rerouting
  • personal itinerary changes

9. TRAVEL INSURANCE

Guests are strongly encouraged to obtain travel insurance covering:

  • health
  • cancellations
  • transportation
  • accidents
  • luggage
  • weather
  • travel interruptions

10. CHECK-IN, CHECK-OUT & CLUB ACCESS

Check-in: 3:00 PM

Check-out: 11:00 AM

Nukumi Club primarily operates through a self check-in / self check-out system.

Notification of delay does not automatically authorize a late check-out.

Unauthorized late departures may result in:

  • additional fees
  • operational disruption
  • housekeeping delays
  • delayed check-ins for following guests

If a guest refuses to vacate the property after unauthorized overstay, Nukumi Club reserves the right to request assistance from local authorities.

11. PRIVATE PARKING

Nukumi Club provides limited private outdoor parking.

One parking space is allocated per confirmed reservation.

Additional parking spaces cannot be guaranteed.

Vehicles are parked entirely at the guest’s own risk.

Nukumi Club cannot be held responsible for:

  • damage
  • theft
  • accidents
  • third-party acts
  • weather-related incidents
  • parking-related events

12. RESPECT FOR THE CLUB ENVIRONMENT & QUIET HOURS

Quiet hours are:

10:00 PM to 8:00 AM

The following are prohibited:

  • parties
  • excessive noise
  • disruptive behavior
  • loud music

Music played in common areas is part of the overall club experience.

13. EXTERNAL VISITORS & GUESTS

External visitors are not permitted without prior approval from management.

Approval may require:

  • identification
  • prior authorization
  • visitor limitations

The main guest remains fully responsible for:

  • visitor behavior
  • damages
  • losses
  • theft
  • incidents caused by invited visitors

14. RESPECT FOR STAFF, GUESTS & ANIMALS

Any behavior considered:

  • aggressive
  • disrespectful
  • threatening
  • violent
  • discriminatory
  • abusive

toward:

  • staff
  • guests
  • partners
  • club animals

may result in immediate expulsion without refund.

15. CLUB ANIMALS & ANIMAL PROTECTION

The club hosts cats living on the property.

It is strictly prohibited to:

  • mistreat animals
  • lock them inside casitas
  • remove their collars
  • feed them without authorization
  • intentionally disturb their behavior

Serious violations may be reported to competent Panamanian authorities in accordance with Panamanian animal protection laws.

No external animals are permitted on the property.

16. POOL, YOGA RANCHO & COMMON AREAS

The pool is open 24/7 but is not supervised.

All posted pool and common area rules must be respected.

The following are prohibited:

  • running
  • diving
  • glass inside the pool
  • food in the water
  • excessive chemical products
  • dangerous behavior

Guests use all facilities entirely at their own risk.

17. SMOKING POLICY

Smoking is prohibited:

  • inside casitas
  • inside the pool
  • or in unauthorized areas

Smoking is only permitted in designated areas equipped with ashtrays.

All cigarette remains must be fully extinguished before disposal.

Additional cleaning or deodorizing fees may apply.

18. HOUSEKEEPING & LAUNDRY

Nukumi Club operates under an Airbnb-style hospitality model.

Daily housekeeping is not included.

A complimentary cleaning may be offered for stays longer than 4 nights.

Additional cleaning services may be requested starting at 20 USD depending on availability.

Additional cleaning fees may apply in cases of abnormal casita conditions.

19. TOWELS, TEXTILES & EQUIPMENT

Each casita includes a total of:

  • 2 hand towels
  • 2 bath towels
  • 2 pool towels

All towels remain the exclusive property of Nukumi Club.

Pool towels are intended exclusively for use within the club and must not be used:

  • at the beach
  • in the ocean
  • outside the property

Towels must not leave the property.

Damage caused by:

  • salt
  • sand
  • tears
  • stains
  • discoloration
  • improper use
  • disappearance

may result in additional charges.

20. DAMAGES, BREAKAGE & MISSING ITEMS

Any breakage or damage must be reported promptly.

Additional charges may apply for:

  • replacement
  • repair
  • cleaning
  • sourcing
  • labor
  • transportation
  • operational disruption

Charges may vary depending on the severity of the damage.

21. KEYS & CASITA SECURITY

One key is provided per reservation.

Lost, damaged, or non-returned keys may result in minimum charges of 50 USD.

22. PERSONAL BELONGINGS & CLAIMS

Guests remain responsible for their personal belongings.

Any claim regarding:

  • theft
  • loss
  • staff behavior
  • damages

must be reported as soon as reasonably possible.

Claims reported after departure may be impossible to verify.

23. SECURITY CAMERAS

Exterior security cameras may be installed in:

  • parking areas
  • entrances
  • exterior access points

No cameras are installed inside casitas.

24. ILLEGAL SUBSTANCES, ILLEGAL ACTIVITIES & AUTHORITIES

Any illegal activity is strictly prohibited.

This includes:

  • illegal drugs
  • trafficking
  • prostitution
  • fraud
  • criminal behavior

Nukumi Club reserves the right to report suspicious or illegal activity to competent authorities.

25. WATER, PLUMBING & SEPTIC SYSTEM

The club water supply comes from a maintained and controlled private well.

Guests must follow all instructions regarding:

  • toilets
  • septic systems
  • plumbing

Solid objects or inappropriate products are prohibited inside toilets.

Plumbing repair fees may apply in cases of misuse.

26. ELECTRICITY, AIR CONDITIONING & HOT WATER

Guests are encouraged to:

  • turn off air conditioning when absent
  • keep doors and curtains closed
  • use utilities responsibly

Hot water systems may differ from European or North American standards.

27. INTERNET, GENERATOR & TECHNICAL INTERRUPTIONS

Nukumi Club uses:

  • Starlink
  • generators
  • local Panamanian infrastructure

Despite all reasonable efforts, interruptions may occasionally occur.

28. TROPICAL ENVIRONMENT & NATURE

Santa Catalina is a tropical environment.

Guests acknowledge the possible presence of:

  • insects
  • humidity
  • rain
  • animals
  • vegetation
  • heat

29. MEDICAL EMERGENCIES & LIABILITY

911 emergency services are available for life-threatening emergencies.

For non-life-threatening situations, medical transportation may require independent travel to SonĂ¡ or Santiago.

Nukumi Club may provide reasonable assistance but does not guarantee:

  • ambulance availability
  • transportation
  • medical availability
  • immediate assistance

30. EMERGENCY ACCESS TO CASITAS

Nukumi Club reserves the right to enter a casita in cases of:

  • emergency
  • leaks
  • fire risk
  • safety concerns
  • urgent maintenance
  • reasonable suspicion of rule violations

31. EXTERNAL ACTIVITIES & THIRD-PARTY PARTNERS

Recommended activities are operated by independent providers.

Nukumi Club cannot be held responsible for:

  • accidents
  • injuries
  • cancellations
  • losses
  • disputes related to external services

32. LIMITATION OF LIABILITY

To the maximum extent permitted under Panamanian law, Nukumi Club cannot be held responsible for:

  • indirect losses
  • delays
  • accidents
  • interruptions
  • weather events
  • third-party acts
  • circumstances beyond our reasonable control

33. RIGHT TO REFUSE SERVICE & EXPULSION

Nukumi Club reserves the right to:

  • refuse
  • cancel
  • terminate a stay without refund

in cases involving:

  • rule violations
  • fraud
  • violence
  • disturbances
  • drugs
  • adults-only policy violations
  • external animals
  • danger to staff, guests, or club animals

34. ACCEPTANCE OF TERMS

These Terms & Conditions are considered accepted:

  • upon reservation
  • payment
  • or stay at the property

Failure to read these conditions does not exempt guests from their application.

35. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of Panama.
